These Terms of Service (“Terms”) govern your use of getvelyvo.com and purchases from VELYVO. The website and store are operated by M&A KULGA SOLUTION, S.L., CIF/NIF/VAT B21845359, with registered address at Calle de Maestro Alonso, 85, 03010 Alicante, Alicante, Spain (“VELYVO,” “we,” “us,” or “our”).
By accessing the website or placing an order, you agree to these Terms. Mandatory consumer rights that apply to you are not excluded or reduced by these Terms.
1. ELIGIBILITY
You must be legally capable of entering into a binding contract in your jurisdiction. If you are under the age of legal majority, you may use the store only with the involvement and consent of a parent or legal guardian.
You must provide accurate, complete, and current information when ordering.
2. ONLINE STORE PLATFORM
Our store is hosted on Shopify, which provides the ecommerce platform used to display products, process checkout, and support store operations. Shopify is not the seller of VELYVO products unless expressly stated otherwise.
3. PRODUCTS AND INFORMATION
We make reasonable efforts to describe products accurately. Colours and appearance may vary because of screens, lighting, production batches, and minor manufacturing updates. Measurements are approximate unless expressly stated as exact.
Product photographs that show packaging, accessories, or surroundings are illustrative unless the product page states that those items are included. The contents of the package are those listed in the “What’s Included” or equivalent section at the time of purchase.
VELYVO FreshSeal is a heat bag sealer. It is not a vacuum sealer and does not remove air from a package. Compatibility depends on the packaging material. It is intended for compatible heat-sealable plastic and foil-lined bags and may not work with plain paper, fabric, or non-heat-sealable materials.
4. SAFE PRODUCT USE
Read and follow the supplied instructions before use. The heating area becomes hot during operation.
You agree to:
- keep the product and heating area away from children;
- avoid touching the heating surface during and immediately after operation;
- use only on clean, dry, compatible packaging;
- never use the product on flammable, pressurised, hazardous, medical, or unknown materials;
- not immerse the device in water or use it when wet;
- charge it only with a compatible power source and cable; and
- stop using it if it is damaged, overheats, smells unusual, or behaves abnormally.
The product is not intended to replace refrigeration, food-safety practices, approved canning, or vacuum packaging. A thermal seal does not make unsafe food safe and does not guarantee a specific shelf life.
5. PRICES AND CURRENCIES
Prices may be displayed in USD, EUR, or another currency supported at checkout. The final currency, price, discounts, shipping, taxes, and any collected duties are shown before payment.
Currency conversion rates may change. Your bank or card issuer may charge conversion or international transaction fees that we do not control.
We may correct obvious pricing or typographical errors before accepting an order. If an error affects an order already placed, we will contact you and offer the choice to confirm the corrected order or cancel for a refund.
6. TAXES AND CUSTOMS
Taxes and duties are handled based on the destination and checkout configuration. If import duties or local charges are not collected at checkout, the recipient may be responsible for them. See the Shipping Policy for details.
7. ORDERS AND ACCEPTANCE
An order confirmation acknowledges that we received your request; it does not necessarily mean the order has been accepted. We may refuse or cancel an order for legitimate reasons, including suspected fraud, payment failure, inaccurate information, stock unavailability, shipping restrictions, sanctions compliance, or an obvious error.
If we cancel after payment, we will refund the amount charged for the cancelled item or order.
We may limit quantities sold to one customer, household, address, payment method, or reseller where reasonably necessary.
8. PAYMENT
We accept major payment cards and any additional payment methods displayed at checkout. Payments are processed through Shopify Payments and associated providers.
You represent that you are authorised to use the selected payment method. We may perform verification or fraud checks before fulfilment.
9. ORDER CANCELLATION
You may request cancellation within 12 hours after placing an order if fulfilment has not begun. We cannot guarantee cancellation after the order has entered processing or shipped.
This operational cancellation window does not limit any mandatory right of withdrawal or cancellation available under applicable consumer law. See the Return & Refund Policy.
10. SHIPPING AND DELIVERY
Orders may be fulfilled by third-party partners in different regions. Processing, estimated delivery, tracking, customs, multiple packages, delays, and address responsibilities are described in the Shipping Policy.
Risk of loss passes only as provided by applicable law. Nothing in these Terms transfers risk to a consumer earlier than legally permitted.
11. RETURNS, REFUNDS, AND WITHDRAWAL
Our voluntary 30-day money-back guarantee begins on the delivery date and is governed by the Return & Refund Policy.
EU/EEA consumers generally have a statutory 14-day right of withdrawal for online purchases, subject to legal exceptions. Mandatory rights take priority over any conflicting term.
12. CONFORMITY AND WARRANTY
Defective or non-conforming goods are covered by the mandatory legal rights applicable in the customer’s location. Consumers in Spain generally have a three-year statutory conformity period for new goods. Consumers elsewhere in the EU/EEA benefit from at least the mandatory period under applicable national law.
The voluntary 30-day money-back guarantee is not a substitute for legal conformity rights. See the Warranty Policy.
13. FREE SHIPPING PROMOTION
Unless a promotion states otherwise, free standard shipping applies when the merchandise subtotal reaches USD $29 or the equivalent shown at checkout, after discounts and before taxes, duties, or government charges.
14. CUSTOMER ACCOUNTS
If customer accounts are available, you are responsible for keeping login credentials secure and for activity under your account. Contact us promptly if you suspect unauthorised access.
We may suspend or close an account used for fraud, abuse, unlawful activity, or repeated breach of these Terms, subject to applicable law.
15. REVIEWS AND USER CONTENT
When you submit a review, photograph, video, comment, or other content, you confirm that:
- you created it or have permission to submit it;
- it is accurate to the best of your knowledge;
- it does not infringe intellectual property, privacy, or other rights;
- it is not unlawful, abusive, deceptive, defamatory, or malicious; and
- it does not contain malware or unauthorised advertising.
You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, translate, display, and use submitted content for operating and promoting the store, subject to your privacy rights and any specific consent requirements.
We may moderate content for legal, safety, relevance, or authenticity reasons. We will not suppress genuine negative reviews merely because they are negative.
16. INTELLECTUAL PROPERTY
The VELYVO name, logos, website design, text, graphics, product photography, videos, and other content are owned by us or used under licence and are protected by applicable intellectual property laws.
You may use the website for personal, non-commercial shopping purposes. You may not copy, scrape, reproduce, sell, modify, distribute, or exploit protected content without written permission, except where law permits.
17. PROHIBITED USES
You may not use the website to:
- violate law or another person’s rights;
- commit fraud or provide false information;
- introduce malicious code or interfere with security;
- scrape or harvest data without permission;
- impersonate another person;
- attempt unauthorised access;
- place orders for unlawful export, resale, or sanctions evasion; or
- use the product for an unsafe or unlawful purpose.
18. THIRD-PARTY SERVICES AND LINKS
The store may include services or links provided by third parties, including payment, delivery, review, social, or support providers. We are not responsible for an independent third party’s website or conduct, except to the extent that applicable law makes us responsible for our own service providers or contractual obligations.
19. PRIVACY AND COOKIES
Our handling of personal information is described in the Privacy Policy. Cookie use is described in the Cookie Policy.
20. AVAILABILITY AND CHANGES
We may update, suspend, or discontinue website features or products. We do not guarantee uninterrupted or error-free website availability. We will honour accepted orders and mandatory rights despite a website change.
21. DISCLAIMERS
To the extent permitted by law, the website and general informational content are provided on an “as available” basis. We do not promise that every packaging material will seal successfully or that sealed food will remain fresh for a specific period.
Nothing in these Terms excludes legal guarantees, product-safety duties, or other rights that cannot lawfully be excluded.
22. LIMITATION OF LIABILITY
To the maximum extent permitted by law, VELYVO is not liable for indirect or unforeseeable loss arising from misuse of the product, failure to follow instructions, incompatible packaging, or circumstances outside our reasonable control.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, wilful misconduct, gross negligence where applicable, breach of mandatory product-safety obligations, or any liability that cannot lawfully be limited.
For consumers, any limitation applies only to the extent compatible with mandatory consumer law.
23. INDEMNITY
Where permitted by law and only to the extent reasonable, you agree to reimburse us for losses caused by your unlawful use of the website, deliberate infringement of another person’s rights, fraud, or material breach of these Terms. This section does not apply to ordinary consumer use or reduce mandatory rights.
24. SEVERABILITY
If a provision is held invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.
25. NO WAIVER
Failure to enforce a provision immediately does not waive the right to enforce it later.
26. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of Spain, without depriving consumers of mandatory protections available under the law of their country of habitual residence.
Disputes should first be submitted to us at get.velyvo@gmail.com so we can attempt an amicable resolution. Where the customer is a consumer, jurisdiction will be determined by mandatory consumer and procedural law, including any right to bring a claim in the courts of the customer’s domicile where applicable.
27. CHANGES TO THESE TERMS
We may update these Terms for legal, operational, security, or service changes. The version published when you place an order governs that order unless a mandatory law requires otherwise.
